AGREEMENT TO OUR LEGAL TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and:

By accessing or using our platform and services ("Services"), you agree that you have read, understood, and agreed to be bound by these Terms.

IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT USE THE SERVICES.

We may update these Terms from time to time. Where required, we will provide notice of such changes in advance. Continued use of the Services after the effective date of updated Terms constitutes your acceptance of those changes.

We recommend that you review these Terms periodically and retain a copy for your records.

1. Nature of Services

IndoEvisa is an independent private platform that provides technology-enabled administrative support and document facilitation services in connection with Indonesian visa applications and related travel documentation.

We are not a government authority, embassy, consulate, or immigration office, and we are not affiliated with, endorsed by, or acting on behalf of the Government of Indonesia unless expressly stated otherwise in writing.

Our services may include collecting user information, reviewing submitted documents for completeness, organizing application materials, assisting with form preparation, coordinating submission processes, communicating procedural updates, and providing general informational support related to visa applications.

We do not make immigration decisions and we do not control the outcome, approval time, refusal, delay, suspension, or cancellation of any visa or immigration application. All visa approvals, refusals, and related decisions are made solely by the relevant government authorities.

Unless expressly agreed in a separate written engagement, IndoEvisa does not provide legal advice, immigration legal advice, or individualized professional advice. Any information made available through our platform, website, communications, or support channels is provided for general informational and administrative purposes only and should not be treated as legal advice or a guarantee of eligibility, approval, or timing.

By using our services, you acknowledge and agree that:

(a) submission of an application does not guarantee visa approval;

(b) government authorities may request additional information or documents at any time;

(c) processing times are estimates only and may change without notice; and

(d) the accuracy, completeness, and authenticity of all information and documents provided by you remain your responsibility.

Nothing in this clause limits any rights that you may have under applicable consumer protection law.

2. Payments, Fees, and Refunds

2.1 Fees and Payment

All fees for the Services are displayed on the platform or otherwise communicated to you prior to payment. By making a payment, you agree to pay all applicable fees and authorize us and our payment processors to charge your selected payment method.

Fees are charged for administrative processing, platform usage, and facilitation services provided by IndoEvisa.

2.2 Nature of Services (Non-Outcome Based)

You acknowledge and agree that:

(a) the Services are provided on a fixed-service basis and are not contingent upon visa approval or any decision by a government authority;

(b) fees are charged for work performed, system access, and administrative handling regardless of the outcome; and

(c) visa decisions are made solely by government authorities and are outside our control.

2.3 Service Commencement

You acknowledge and agree that the Services may begin immediately after payment is completed.

Where permitted by applicable law, you expressly request and consent to the immediate commencement of the Services before the expiry of any statutory withdrawal or cancellation period.

You acknowledge that once performance has begun, your right to cancel or withdraw may be reduced or lost, to the extent permitted by applicable law.

2.4 Refunds and Cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

In summary:

(a) before processing begins, you may be eligible for a full refund of service fees;

(b) once processing has begun, refunds may be reduced to reflect work already performed;

(c) once an application has been submitted or government/third-party fees have been incurred, such fees are non-refundable; and

(d) visa refusal, delay, or outcome does not automatically entitle you to a refund.

Where IndoEvisa is responsible for a material administrative error, remedies will be provided in accordance with the Refund & Cancellation Policy.

2.5 Government Fees and Third-Party Costs

Government fees, embassy fees, and third-party charges are outside our control and are non-refundable once incurred.

Such fees are charged by external authorities or providers and are not retained by IndoEvisa.

2.6 Chargebacks and Payment Disputes

If you have any issue with a payment, you agree to contact us first so we can attempt to resolve the matter promptly and in good faith.

Nothing in this section prevents you from exercising any rights you may have with your payment provider under applicable law.

We reserve the right to provide evidence of services performed, user consent, and acceptance of these Terms in response to any payment dispute or chargeback.

2.7 Fraud and Unauthorized Transactions

We reserve the right to refuse, cancel, or reverse any transaction where we reasonably suspect fraud, unauthorized activity, sanctions exposure, or violation of these Terms.

You agree to cooperate with any investigation relating to payment transactions.

2.8 Currency and Charges

You are responsible for any currency conversion fees, bank charges, or transaction costs imposed by your payment provider.

2.9 Pricing Changes

We may update pricing at any time. Changes will not affect payments already completed.

2.10 Refund Processing

Where a refund is approved, we aim to process it within a reasonable timeframe, typically within 5–10 business days, subject to payment provider processing times.

2.11 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable consumer protection laws, including rights relating to refunds, cancellations, or payment disputes.

3. Intellectual Property Rights

3.1 Ownership

All intellectual property rights in and to the Services, including but not limited to the platform, software, systems, design, text, graphics, logos, trademarks, and all related content (collectively, the "Content"), are owned by or licensed to IndoEvisa and are protected by applicable intellectual property laws.

All rights not expressly granted in these Terms are reserved.

3.2 Limited License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your personal use or internal business purposes.

You may not:

(a) copy, reproduce, distribute, modify, or create derivative works from any part of the Services or Content;

(b) commercially exploit, resell, sublicense, or otherwise use the Services for unauthorized purposes;

(c) reverse engineer, decompile, or attempt to extract the source code of the platform;

(d) remove, alter, or obscure any copyright, trademark, or proprietary notices.

3.3 User Content

You retain ownership of any documents, information, or materials that you submit through the Services ("User Content").

By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to use, store, process, and transmit such content solely for the purpose of providing the Services and fulfilling your requests.

You represent and warrant that:

(a) you have all necessary rights and authority to submit the User Content;

(b) the User Content does not infringe any third-party rights; and

(c) the User Content complies with applicable laws and regulations.

3.4 Feedback

If you provide feedback, suggestions, or ideas regarding the Services ("Feedback"), you grant us a worldwide, royalty-free license to use, reproduce, modify, and incorporate such Feedback into our Services for the purpose of improving and developing our platform, without any obligation or compensation to you.

3.5 Restrictions

Except as expressly permitted under these Terms, no part of the Services or Content may be used, reproduced, or exploited without our prior written consent.

3.6 Protection of Rights

We reserve the right to take appropriate legal action in response to any unauthorized use of the Services or infringement of our intellectual property rights.

3.7 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

4. User Representations

By accessing or using the Services, you represent and warrant that:

(a) you have the legal capacity and authority to enter into and comply with these Terms;

(b) you are at least the age of majority in your jurisdiction of residence;

(c) you will use the Services only for lawful purposes and in compliance with all applicable laws and regulations;

(d) all information and documents you provide are true, accurate, complete, and not misleading;

(e) all documents submitted are authentic, valid, and lawfully obtained;

(f) you have the necessary rights, authority, and consent to submit any information or documents on behalf of yourself or any third party;

(g) your use of the Services will not violate any applicable immigration laws, regulations, or requirements; and

(h) you will not misuse the Services or attempt to interfere with their proper operation.

You acknowledge that providing false, inaccurate, incomplete, or misleading information may result in delays, rejection, cancellation of applications, or legal consequences imposed by relevant authorities, for which we shall not be responsible.

We reserve the right to rely on the information and documents you provide without independent verification.

Nothing in this section limits or excludes any rights you may have under applicable consumer protection law.

5. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  1. use the Services for any unlawful, fraudulent, or unauthorized purpose;
  2. provide false, inaccurate, incomplete, or misleading information in any application or submission;
  3. upload forged, altered, or invalid documents;
  4. impersonate another person or submit applications without proper authorization;
  5. use the Services in violation of any applicable immigration laws or regulations;
  6. submit duplicate, excessive, or abusive applications that may disrupt the Services;
  7. attempt to gain unauthorized access to the Services, accounts, or systems;
  8. interfere with or disrupt the operation, security, or functionality of the Services;
  9. use automated systems, bots, or scripts to access or interact with the Services;
  10. collect or misuse data from the Services without authorization;
  11. use the Services in any manner that could harm, damage, or impair the Company or its reputation.

We reserve the right to suspend, restrict, or terminate access to the Services and reject any application at our sole discretion if we believe a user has violated these provisions.

6. User Content and Submissions

6.1 Nature of User Content

The Services may allow you to submit, upload, or provide documents, information, and other materials in connection with visa applications and related services ("User Content").

User Content is submitted solely for the purpose of enabling us to provide the Services and is not intended to be publicly accessible or shared with other users.

6.2 Responsibility for User Content

You acknowledge and agree that you are solely responsible for all User Content you submit through the Services.

By submitting User Content, you represent and warrant that:

(a) the content is accurate, complete, and not misleading;

(b) you have the legal right, authority, and consent to provide such content;

(c) the content does not violate any applicable law or regulation; and

(d) the content does not infringe the rights of any third party.

We do not independently verify the authenticity, accuracy, or legality of User Content and rely on the information you provide.

6.3 Use of User Content

We may access, review, process, and use User Content solely for the purpose of:

(a) providing the Services;

(b) preparing and managing visa applications;

(c) communicating with you regarding your application; and

(d) complying with applicable legal or regulatory requirements.

6.4 Right to Refuse or Remove Content

We reserve the right to refuse, reject, or remove any User Content where we reasonably believe that such content:

(a) is incomplete, inaccurate, or misleading;

(b) violates these Terms or applicable laws; or

(c) may affect the integrity, security, or proper operation of the Services.

6.5 No Liability for User Content

To the fullest extent permitted by law, we shall not be liable for any loss, damage, delay, rejection, or legal consequence arising from User Content provided by you.

6.6 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

7. License to Use User Content

7.1 Grant of License

By submitting any User Content through the Services, you grant IndoEvisa a limited, non-exclusive, royalty-free, and revocable license to access, use, store, process, and transmit such User Content solely for the purpose of:

(a) providing the Services;

(b) preparing and managing visa applications;

(c) communicating with you regarding your application; and

(d) complying with applicable legal and regulatory requirements.

This license is limited to what is necessary for the operation of the Services and does not transfer ownership of your User Content to us.

7.2 Ownership of User Content

You retain full ownership of all User Content you submit, including any intellectual property rights associated with such content.

Nothing in these Terms grants us ownership of your documents or personal information.

7.3 Feedback

If you provide feedback, suggestions, or ideas regarding the Services ("Feedback"), you grant us a worldwide, royalty-free license to use, reproduce, and incorporate such Feedback into our Services for the purpose of improving and developing the platform, without obligation or compensation to you.

7.4 Responsibility for Content

You remain solely responsible for all User Content you submit. We shall not be responsible for any claims, losses, or damages arising from such content, except where required by applicable law.

7.5 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

8. Service Management

8.1 Monitoring and Compliance

We may monitor the use of the Services to ensure compliance with these Terms, applicable laws, and the proper functioning of the platform.

8.2 Right to Take Action

We reserve the right to take appropriate action, including restricting access, suspending accounts, rejecting applications, or removing content, where we reasonably believe that:

(a) these Terms have been violated;

(b) applicable laws or regulations have not been complied with; or

(c) such action is necessary to protect the integrity, security, or proper operation of the Services.

8.3 Content Review

We may review, but are not obligated to review, any documents, information, or submissions provided through the Services.

We reserve the right to refuse, reject, or remove any content that is incomplete, inaccurate, non-compliant, or otherwise unsuitable for processing.

8.4 Operational Changes

We may manage, modify, update, or restrict the Services as necessary to:

(a) maintain system performance and stability;

(b) improve functionality or user experience;

(c) comply with legal or regulatory requirements; or

(d) protect our business and users.

8.5 No Obligation to Provide Services

Nothing in these Terms shall be interpreted as an obligation for us to accept any user, process any application, or provide Services in any specific case.

8.6 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

9. Term and Termination

9.1 Term

These Terms remain in full force and effect for as long as you access or use the Services.

9.2 Termination by You

You may stop using the Services at any time.

Termination or discontinuation of use does not automatically entitle you to a refund. Any refund rights are governed by our Refund & Cancellation Policy and applicable law.

9.3 Suspension or Termination by Us

We may suspend, restrict, or terminate your access to the Services, in whole or in part, where we reasonably believe that:

(a) you have violated these Terms;

(b) you have provided false, misleading, or incomplete information;

(c) you have submitted invalid, fraudulent, or unlawful documents;

(d) your use of the Services poses a legal, security, or operational risk; or

(e) such action is required to comply with applicable laws or regulatory obligations.

Where reasonably practicable, we will take proportionate action and may provide notice of such suspension or termination.

9.4 Effect of Termination

Upon suspension or termination:

(a) your access to the Services may be restricted or revoked;

(b) any ongoing applications or processes may be paused or discontinued;

(c) we may retain relevant information as required for legal, regulatory, or operational purposes; and

(d) any applicable refunds shall be determined in accordance with our Refund & Cancellation Policy and applicable law.

9.5 No Obligation to Continue Services

Nothing in these Terms obligates us to continue providing Services in any specific case, particularly where legal, regulatory, or compliance concerns arise.

9.6 Survival

Any provisions which by their nature should survive termination shall remain in effect, including but not limited to provisions relating to payments, intellectual property, limitations of liability, indemnification, and dispute resolution.

9.7 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

10. Eligibility, Compliance, Refusal of Service, and Account Suspension

10.1 Eligibility

To use the Services, you must:

(a) have the legal capacity to enter into binding agreements under applicable law; and

(b) comply with all applicable laws and regulations.

We may require you to provide information or documentation to verify your identity or eligibility.

10.2 Identity Verification, Compliance, and AML

We may perform identity verification, due diligence, and compliance checks where reasonably required to:

(a) prevent fraud or misuse of the Services;

(b) comply with legal or regulatory obligations;

(c) protect the integrity and security of the platform; and

(d) comply with applicable sanctions, anti-money laundering (AML), and counter-terrorism financing (CTF) requirements.

We may screen users, transactions, and applications against applicable sanctions lists, AML, and CTF requirements.

You agree to provide any additional information reasonably requested for compliance purposes and to cooperate with such checks.

10.3 Right to Refuse Service

We reserve the right to refuse to provide Services or process any application where we reasonably believe that:

(a) the application does not meet applicable legal or regulatory requirements;

(b) the information or documents provided are incomplete, inaccurate, or unreliable;

(c) there are concerns relating to fraud, misuse, sanctions exposure, or unlawful activity; or

(d) providing the Services would expose us to legal, regulatory, financial, or reputational risk.

10.4 Account Suspension or Restriction

We may suspend, restrict, or limit access to the Services where reasonably necessary to:

(a) investigate potential violations of these Terms;

(b) prevent fraud, abuse, or security risks;

(c) comply with legal or regulatory obligations; or

(d) protect the integrity and proper operation of the Services.

10.5 Cooperation with Authorities

We may cooperate with law enforcement authorities, regulators, or government agencies and may disclose relevant information where required by applicable law or where we reasonably believe such disclosure is necessary.

10.6 Effect on Applications

Where Services are refused, suspended, or restricted:

(a) applications may be delayed, paused, or discontinued; and

(b) any applicable refunds shall be determined in accordance with our Refund & Cancellation Policy and applicable law.

10.7 No Guarantee of Acceptance

Nothing in these Terms shall be interpreted as an obligation for us to accept any user, process any application, or provide Services in any specific case.

10.8 Service Timelines

Any timelines, processing times, or estimated durations provided through the Services are indicative only.

Actual processing times may vary depending on government authorities, third-party systems, and other factors beyond our control.

10.9 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

11. Modifications and Interruptions

11.1 Changes to Services

We may modify, update, or discontinue any part of the Services at any time, including features, functionality, or availability.

Where reasonably practicable, we will provide notice of material changes that may affect your use of the Services.

11.2 Service Availability

We do not guarantee that the Services will be available at all times or free from interruptions.

The Services may be subject to delays, interruptions, or errors due to maintenance, technical issues, or factors beyond our control.

11.3 Interruptions and Technical Issues

Access to the Services may be temporarily unavailable due to:

(a) scheduled or unscheduled maintenance;

(b) system upgrades or modifications;

(c) technical failures or infrastructure issues; or

(d) external factors, including third-party system disruptions.

11.4 Limitation of Responsibility

To the extent permitted by applicable law, we shall not be responsible for any loss, damage, or inconvenience resulting from interruptions, delays, or temporary unavailability of the Services, particularly where such events are outside our reasonable control.

11.5 No Obligation to Maintain Services

Nothing in these Terms obligates us to maintain, support, update, or continue providing the Services in their current form.

11.6 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

12. Force Majeure

12.1 Force Majeure Events

We shall not be liable for any failure, delay, or interruption in the performance of the Services where such failure or delay results from events beyond our reasonable control ("Force Majeure Event").

Force Majeure Events include, but are not limited to:

(a) natural disasters, acts of God, earthquakes, floods, fires, or pandemics;

(b) government actions, regulations, restrictions, or changes in immigration laws or policies;

(c) war, terrorism, civil unrest, or national emergencies;

(d) labor disputes, strikes, or shortages of personnel;

(e) failures or disruptions of third-party systems, including government platforms, embassies, consulates, payment processors, or telecommunications networks;

(f) power outages, internet failures, or infrastructure disruptions;

(g) cyberattacks, hacking incidents, or security breaches beyond our reasonable control.

12.2 Suspension of Obligations

During a Force Majeure Event, our obligations under these Terms shall be suspended for the duration of the event, to the extent affected.

12.3 Extended Force Majeure

Where a Force Majeure Event continues for a prolonged period, we may suspend or discontinue the affected Services without liability, to the extent permitted by applicable law.

12.4 Consumer Rights

Nothing in this section limits or excludes any rights you may have under applicable law.

13. Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

If you are a consumer, you may also have rights under the mandatory laws of your country of residence. Nothing in these Terms limits or excludes any rights you may have under applicable law.

14. Dispute Resolution

14.1 Informal Resolution

If a dispute arises, you agree to first contact us and attempt to resolve the matter in good faith.

Both parties agree to attempt informal resolution for at least thirty (30) days from the date written notice of the dispute is provided.

14.2 Consumer Disputes

If you are using the Services as a consumer, you may have the right to bring a claim before the courts of your country of residence.

Nothing in this section limits any mandatory rights you may have under applicable law, including the right to access your local courts where such rights cannot be waived.

14.3 Business Users (Arbitration)

If you are using the Services for business or commercial purposes, any dispute arising out of or in connection with these Terms shall be finally resolved by arbitration.

The arbitration shall:

(a) be conducted under the rules of the Indonesian National Arbitration Board (BANI);

(b) be seated in Jakarta, Indonesia;

(c) be conducted in the English language;

(d) be conducted by one (1) arbitrator.

The arbitral award shall be final and binding.

14.4 Injunctive Relief

Nothing in this section prevents either party from seeking urgent injunctive or equitable relief before a court of competent jurisdiction where necessary.

14.5 No Mandatory Arbitration for Consumers

Arbitration shall not apply to consumers where such requirement is prohibited or restricted by applicable law.

14.6 Time for Claims

Claims must be brought within the time limits required by applicable law.

Nothing in this section shortens or limits any statutory limitation periods that cannot be lawfully modified.

15. Corrections and Updates

We may correct any errors, inaccuracies, or omissions on the Services at any time, including information relating to descriptions, pricing, availability, or other content.

We reserve the right to update or modify such information without prior notice.

16. Disclaimer of Warranties

16.1 General Disclaimer

The Services are provided on an "as-is" and "as-available" basis.

To the fullest extent permitted by applicable law, we make no representations or warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose, or non-infringement.

16.2 No Professional Advice

The Services do not constitute legal advice, immigration advice, or any form of professional advisory service.

All information provided through the Services is for general informational and administrative purposes only and should not be relied upon as professional advice.

16.3 No Guarantee of Outcome

We do not guarantee any outcome in relation to visa or immigration applications.

All decisions, including approval, rejection, processing time, and conditions, are made solely by the relevant government authorities.

16.4 Third-Party and Government Dependency

The Services rely on third-party systems, including government platforms, embassies, consulates, and payment providers.

We do not control and are not responsible for the availability, performance, or actions of such third parties.

16.5 Platform-Based Services

The Services are delivered through a digital platform that facilitates administrative processes and coordination.

We do not guarantee that the Services will be uninterrupted, error-free, or free from delays.

16.6 User Responsibility

You are solely responsible for your use of the Services, including the accuracy of information submitted and compliance with applicable laws and requirements.

16.7 Limitation by Law

Nothing in this section limits or excludes any warranties or rights that cannot be excluded under applicable law.

17. Limitation of Liability

17.1 Scope of Liability

To the fullest extent permitted by applicable law, our liability arising out of or in connection with the Services shall be limited as set out in this section.

17.2 Exclusion of Certain Damages

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

(a) loss of profit, revenue, business, opportunity, or goodwill;

(b) loss or corruption of data;

(c) delays, interruptions, or inability to use the Services;

(d) visa rejection, refusal, delay, cancellation, or any decision made by a government authority.

17.3 Specific Exclusions

We shall not be responsible for any loss or damage arising from:

(a) decisions or actions of government authorities;

(b) delays or requirements imposed by embassies, consulates, or immigration authorities;

(c) changes in laws, regulations, or policies;

(d) information or documents provided by you;

(e) failures or issues relating to third-party systems, platforms, or payment providers; or

(f) events beyond our reasonable control.

17.4 Liability Cap

To the fullest extent permitted by law, our total aggregate liability shall be limited to the total amount paid by you to us for the specific Services giving rise to the claim.

17.5 No Guarantee of Outcome

You acknowledge that visa outcomes are determined solely by government authorities, and we shall not be liable for any outcome of an application.

17.6 Basis of Agreement

You acknowledge that the fees charged for the Services reflect a fair allocation of risk between you and us, and that this limitation of liability is an essential basis of the agreement.

17.7 Non-Excludable Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or any other liability that is legally non-excludable.

17.8 Consumer Rights

If you are a consumer, this section applies only to the extent permitted by applicable law. Nothing in this section limits or excludes any mandatory rights you may have.

18. Indemnification

18.1 Indemnity Obligation
